In the event of any dispute, claim or controversy arising out of or relating to these Terms or the Website (collectively, a "Dispute"), the parties shall first attempt to resolve the Dispute through good-faith negotiation.
If the Dispute is not resolved through negotiation within thirty (30) days, the Dispute shall be finally resolved through binding arbitration seated in Noida, India, in accordance with the Arbitration and Conciliation Act, 1996 of India, by a sole arbitrator appointed by the Company. The language of the arbitration shall be English, and the award shall be final and binding on both parties.
17. General Provisions
- Severability: If any provision of these Terms is held to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
- Entire agreement: These Terms, together with the Privacy Policy and any separate service agreement, constitute the entire agreement between you and the Company regarding the Website.
- Waiver: No failure or delay by the Company in exercising any right under these Terms shall constitute a waiver of that or any other right.
